Agreement and eligibility

By creating an account or using Apex, you agree to these terms and the Privacy Policy. You must be at least 18 years old, located in the United States, legally able to enter this agreement, and use Apex only for yourself unless we expressly approve another use. Do not use Apex where doing so would violate applicable law.

What Apex provides

Apex provides tools for personal wellness, fitness, nutrition, performance tracking, lab organization, and AI-assisted education. Features may include manual, photo-assisted, and voice-assisted logs, document extraction, educational coaching, plans, local reminders, widgets, and Shortcuts.

Founding access and waitlist

Apex is free during its founding release. New account creation is limited to the first 100 members. When that capacity is reached, an eligible adult in the United States may join the waitlist and consent to receive access-related email. A waitlist submission is not an account, does not guarantee access or a particular invitation time, and can be withdrawn by contacting Apex. Existing member access is not affected solely because founding capacity has been reached.

Not medical care

Apex is not a medical device, healthcare provider, emergency service, diagnostic tool, or substitute for professional care. AI responses, nutrition estimates, plans, lab summaries, trends, and reminders may be incomplete or inaccurate. Review outputs and consult a qualified clinician before making medical, medication, supplement, diet, or training decisions. Call 911 or your local emergency service in an emergency.

Your account and content

You are responsible for accurate account information, the security of your credentials, and all activity under your account. You retain ownership of content you submit. You grant Apex the limited permission needed to host, process, transmit, back up, and transform that content only to operate, secure, and support the features you request, as described in the Privacy Policy. You must have the right to submit every document, image, recording, or other item you upload.

AI features

AI output is probabilistic and can be wrong. It must not be treated as fact, a diagnosis, or individualized medical advice. Food, workout, lab, plan, and other drafts require your review. You are responsible for deciding whether and how to use an output and for seeking appropriate professional advice.

Acceptable use

You may not:

• interfere with Apex or bypass security or usage controls;
• use another person's credentials or submit their confidential health information without authority;
• upload malicious, illegal, deceptive, abusive, or infringing content;
• automate excessive requests, probe the service, or attempt unauthorized access; or
• use Apex to provide unlicensed medical care.

Availability and changes

Apex may change, suspend, rate-limit, or discontinue features when reasonably needed for security, safety, legal compliance, maintenance, or service quality. Offline logs and cached data are convenience features, not a guaranteed backup. Export information you need to keep. Material changes to these terms will be posted with a new effective date.

Account suspension and deletion

You may stop using Apex at any time. Permanent account deletion is available from Account → Privacy & account data. Apex may restrict or terminate access for a material breach, security risk, harmful activity, or legal requirement, subject to applicable law. Account deletion and any narrow retention exceptions are described in the Privacy Policy.

Third-party and Apple terms

Apex depends on services supplied by Apple, Supabase, and Google. Their services may have separate terms and availability. Use of the iOS app is also subject to Apple's Standard Licensed Application End User License Agreement. Apple is not responsible for Apex support or health guidance.

Disclaimers and liability

To the fullest extent permitted by law, Apex is provided “as is” and “as available,” without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, or noninfringement. To the fullest extent permitted by law, Enloq, Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost data, or lost profits arising from Apex. Nothing in these terms excludes rights, warranties, or liability that applicable consumer law does not permit us to exclude.

Governing law and venue

New York law governs these terms, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in New York County, New York, and each party consents to their jurisdiction. Mandatory consumer protections and rights that cannot lawfully be waived remain in effect.

General terms

If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these terms without written consent. These terms and the Privacy Policy are the agreement between you and Enloq, Inc. concerning Apex, subject to Apple's applicable terms.
